Effective January 1st, 2020 there has been a major revision, and evolution to the New York State criminal procedure law under section 245. This includes bail reform whereby bail cannot be set by a court unless the defendant falls within one of the few exception categories. Further, it has enhanced a defendant’s rights regarding all discoverable material from traffic infractions through A-1 felonies. The prosecution must provide (unless waived by the defendant) all discoverable material pursuant to the statued within fifteen days of the defendant’s arraignment. The new law is predominately defendant friendly and allows them access to information that in some cases would not be seen until a trial.
